The Bloomberg Law article, by Daniel Seiden, covered a recent U.S. Court of Federal Claims decision in which the court granted discovery (depositions) in a bid protest.
From the article: "The court’s decision [in MetroIBR JV LLC vs. United States] is also noteworthy because 'we typically do not see discovery in bid protest cases,' said government contractor attorney Joshua B. Duvall of Maynard Nexsen PC. Because 'the information sought in these types of cases is typically not in the record, courts may allow discovery because the omission of that information would preclude effective judicial review.'"
