Bid protest and government contracts attorney Josh Duvall recently published a Law360 Expert Analysis article, "Bid Protest Data Contradicts Claims That System Is Inefficient." The article analyzes recent U.S. Government Accountability Office ("GAO") and U.S. Court of Federal Claims ("COFC") protest data and offers insight that contradicts claims – held by some in industry and government – that the system is flooded with bid protests that cause significant delays in federal procurement.

From the article: "Rather than being a driving force behind delay or dysfunction, bid protests serve as a crucial check against agency decision-making that is unfair, flawed or contrary to procurement rules, and they help ensure the procurement process remains fair and accountable. A clearer picture of the GAO and COFC bid protest data therefore demonstrates that the process is functioning as intended and often results in quick resolutions for the lion's share of protests."
